Michael J. Garofola leads FROST LLP’s New York office. Born and raised in New York, Garofola is a multi-faceted business litigator whose career spans years as a federal prosecutor, as senior in-house counsel at publicly traded companies, and in litigation roles at major New York law firms. With firsthand knowledge of in-house counsel expectations, Garofola’s experience covers regulatory, compliance, commercial contracting, corporate governance, data privacy and cybersecurity, and intellectual property matters. He also has extensive knowledge of legal issues in emerging commercial and technology sectors, from cannabis to renewable energy and electric vehicles (EV).

Consistent with FROST LLP’s commitment to conservation, Garofola served as Sr. Director of Compliance & Litigation at a leading electric vehicle infrastructure company that boasts one of the nation’s largest public EV charging networks.

As SVP, Sr. Deputy General Counsel and Head of Litigation at one of the nation’s largest publicly traded, multi-state operators of cannabis licenses and assets, Garofola handled the company’s most important legal affairs and specialized in mitigating criminal, regulatory, operational, financial, and reputational risk across all departments.

Garofola has also served as a criminal Assistant United States Attorney, in the U.S. Attorney’s Office for the Southern District of Florida. Garofola led the investigations of over 300 federal criminal cases in the Major Crimes and Narcotics sections. He amassed substantial government enforcement and trial experience in cases involving financial crimes, international money laundering, the Bank Secrecy Act (BSA), the Foreign Corrupt Practices Act (FCPA), the Securities Act of 1933 and the Securities Exchange Act of 1934, human trafficking, child exploitation, international narcotics trafficking, violent and gang-related crimes, and firearms offenses. Garofola has also successfully argued before the U.S. Court of Appeals for the Eleventh Circuit.

In addition, Garofola served as General Counsel for an international trade and export company, managing its commercial contracts, litigation, government enforcement, regulatory compliance, corporate governance, and advising on all business transactions. He is a licensed U.S. Customs Broker with extensive knowledge of international trade and export compliance.

Garofola has also litigated cases while at New York law firms Davis Polk & Wardwell LLP and Kobre & Kim LLP.

Garofola holds a Bachelor of Arts from the University of Notre Dame and a J.D. from the Fordham University School of Law. He is licensed to practice law in New York and Texas and licensed as Registered In-House Counsel in California.

An experienced media personality, Garofola is a frequent commentator on politics, sports, television, and pop culture. He is the proud dog dad of a rescue dog named Rosie.
